NOTICE TO CLAIMANTS OF COMPLAINT FOR
EXONERATION FROM AND/OR LIMITATION OF LIABILITY
NOTICE IS HEREBY GIVEN that Crosby Dredging, L.L.C. (Crosby Dredging), Crosby Marine Transportation, L.L.C. (Crosby Marine), and Crosby Tugs, L.L.C. (Crosby Tugs), (referred to hereinafter collectively as the Petitioners) as the alleged owners and/or owners pro hac vice of the M/V DELTA DUCK and Barge KS-1354 (referred to hereinafter collectively as the Vessels), along with all of their respective cargo, engines, tackle, gear, appurtenances, etc. in rem; have filed a Complaint and Petition for Exoneration From and/or Limitation of Liability pursuant to 46 U.S.C. 30501 et seq., and Rule F of the Supplemental Rules for Certain Admiralty and Maritime Claims for any loss, damage, death, injury or destruction allegedly caused by or resulting from the voyage and/or incident more fully described in the Complaint and Petition of Petitioners, as the alleged owners and/or owners pro hac vice of the M/V DELTA DUCK and Barge KS-1354, filed in the United States District Court for the Eastern District of Louisiana on the 29th day of July 2025.
All persons, firms, corporations, or other legal entities asserting claims with respect to which the Complaint seeks limitation and/or exoneration are advised to file their respective claims with the Clerk of Court at the United States District Courthouse, 500 Poydras Street, New Orleans, Louisiana, 70130, and to serve on the attorneys for Petitioners, Miles P. Clements, Joseph E. Lee III, and Ashley F. Bossier with the law firm of Phelps Dunbar LLP, 365 Canal Street, Suite 2000, New Orleans, Louisiana 70130, a copy thereof, on or before the 19th day of September, 2025, or be defaulted. Personal attendance is not required.
Any claimant desiring to contest either the right of exoneration from or the right to limitation of liability shall file and serve an answer to the Complaint and Petition on or before the above date unless his claim has included an Answer, all as required by Rule F of the Supplemental Rules for Certain Admiralty and Maritime Claims.
