NOTICE OF APPLICATION FOR AUTHORITY
TO SELL IMMOVABLER PROPERTY AT PRIVATE SALE
NOTICE IS GIVEN that KATHLEEN MCFALL WILEY and MATTHEW JOSEPH MCFALL, III, the Administrators of the Succession of Matthew Joseph McFall, Jr. are, pursuant to the provisions of Louisiana Civil Code of Procedure, article 3281, petitioning the Honorable Court for authority to sell at private sale, the Successions undivided one-half (1/2) interest in the property described below for the highest possible price, but not less than the amount of the value set forth in the appraisal of October 2, 2024, which estimated the property in its condition at the time at One Hundred Twenty Thousand Five Hundred and 00/100 ($120,500.00) Dollars. However, due to improvements made on the property since the appraisal, the sale should be for a higher amount than the appraisal, based on the current fair market value of the property, which property is further described as follows:
TWO CERTAIN LOTS OF GROUND, together with all the buildings and improvements thereon, and all the rights, ways, privileges, servitudes, appurtenances and advantages thereunto belonging or in anywise appertaining, situated in the City of Kenner, Parish of Jefferson, State of Louisiana, in that part thereof known as Highway Park Subdivision, in Square 474, bounded by Iowa Avenue, 22nd (formerly 4th) Street, Kansas Avenue and 21st (formerly 3rd) Street, which said lots of ground are designated by the Numbers 5 and 6, adjoin each other, and measure each twenty-five feet, no inches, no lines (25 0 0) front on Iowa Avenue, the same in width in the rear, which fronts on a 15-foot alley running through said square from 21st Street in the direction of 22nd Street, by a depth of one hundred twenty feet, no inches, no lines (120 0 0) between equal and parallel lines; Lot 5 being nearer to and commencing at a distance of one hundred feet, no inches, no lines (100 0 0) from the corner of Iowa Avenue and 22nd Street, all according to sketch of survey by Adlow Orr, Jr. & Associates, Consulting Engineers, dated November 10, 1959, a copy of which is annexed to an Act passed before D. L. Kirshenheuter, Jr., Notary Public, dated November 11, 1959, for reference.
The improvements thereon bear the Municipal Number 2118 Iowa Avenue.
Being the same property acquired by Mary Ann Lutostanksi, wife of, and Matthew J. McFall, Jr. from Fidelity Homestead Association by Sale of Property dated April 7, 1969 and recorded in COB 695, folio 487 in the conveyance records of Jefferson Parish, Louisiana.
NOW THEREFORE, in accordance with law, notice is hereby given that KATHLEEN MCFALL WILEY and MATTHEW JOSEPH MCFALL, III, the Administrators of the Succession of Matthew Joseph McFall, Jr., proposes to sell the aforesaid immovable property, at private sale, for the price and upon the terms aforesaid, and the heirs, legatees, and creditors are required to make opposition, if any they have or can, to such sale, within seven (7) days, including Sundays and holidays, from date whereon the last publication of this notice appears.
