NOTICE OF ADOPTION
The following ordinance, which was previously introduced in written form at a special meeting of the New Iberia City Council on April 15, 2025, a summary thereof having been published in the official journal, together with a notice of public hearing which was held on May 6, 2025, in accordance with said public notice, was brought up for final passage on motion of Troy Comeaux and seconded by Warren White:

AN ORDINANCE ENLARGING THE BOUNDARIES OF THE CITY OF NEW IBERIA, LOUISIANA AND AMENDING THE CHARTER OF THE CITY OF NEW IBERIA
WHEREAS Hebert Family Estate, Et Als, have petitioned the City of New Iberia for annexation of an approximately 24.45 acres of land located adjacent to but outside of the corporate limits of the City of New Iberia, more particularly described as follows:
That certain tract of land with all buildings and improvements thereon together with all rights, ways, privileges and servitudes thereto appertaining located in Section 21, Township 12 South, Range 6 East, Iberia Parish, Louisiana, containing 24.45 acres, more or less, bounded north by property of Emilda Babineaux Robichaux, or assigns, south by W Hwy 90 Frontage Road and property of Theodore A. Leleux, east by properties of City of New Iberia, Brown Florida Holdings, LLC, BAPU 5 of New Iberia, LLC and Waffle House, LLC, or assigns, and west by properties of Sutton Industries, Inc., AAP Investments, LLC and Theodore A. Leleux or assigns, the tract made up of the following five contiguous tracts:
1. That tract assessed under Iberia Parish Assessors Parcel No. 0102464999 and further described as follows:
a. A 20.62 acre tract of land situated in Section 21, Township 12 South, Range 6 East, Southwestern Land District, in Ward 1 of Iberia Parish, Louisiana, bounded Northerly by Estate of John Robichaux, or assigns, Southerly by Private Road, Easterly by Estate of Edward M. Boutte, or assigns, and Westerly by Roland Robichaux, or assigns and Daryl Charpentier, et al, or assigns; Being more fully set forth on a plat of survey by G.K. Pratt Munson, S.S., dated April 11, 1983 and filed for record in the Succession of Laurence Hebert, Probate Docket No. 11596 of the 16th Judicial District in and for Iberia Parish, Louisiana.
b. An irregularly shaped strip of land 50 feet in width, designated as a Private Road, shown and depicted on that plat of survey by G.K. Pratt Munson, S.S., dated April 11, 1983 and filed for record in the Succession of Laurence Hebert, Probate Docket No. 11596 of the 16th Judicial District in and for Iberia Parish, Louisiana; said road being located in part between lots designated as belonging to Dennis Leleux and Louis P. Hebert and between Mrs. Laurence R. Hebert and E. M. Boutte Estate, and also running behind or north of lots belonging to Dennis Leleux, Louis P. Hebert, Webster Hebert, Oliver Andre and Mrs. Laurence R. Hebert.
2. That tract assessed under Iberia Parish Assessors Parcel No. 0102430000 and further described as follows:
That certain tract of land, with all improvements thereon, situated in Ward 1 (formerly Ward 9) of Iberia Parish, Louisiana, in Section 21, Township 12 South, Range 6 East, Iberia Parish, Louisiana, together with all rights, ways, servitudes and appurtenances thereunto belonging, measuring one hundred twenty-six and one-tenth (126.1) feet front on the north side of Public Highway, by a depth between parallel lines of two hundred (200) feet, and being bounded on the north by a Forty Foot Strip reserved by and belonging to vendor Laurence Robichaux Hebert, on the south by Public Highway, on the east by property formerly belonging to vendor Laurence Robichaux Hebert, this day conveyed to Webster Hebert, and on the west by a forty foot strip of land reserved by and belonging to vendor Laurence Robichaux Hebert or assigns. The address of the property is given as 708 W Hwy 90, New Iberia, LA 70560.
3. That tract assessed under Iberia Parish Assessors Parcel No. 0102464000 and further described as follows:
That certain tract of land, with all improvements thereon, situated in Ward 1 (formerly Ward 9) of Iberia Parish, Louisiana, in Section 21, Township 12 South, Range 6 East, Iberia Parish, Louisiana, together with all rights, ways, servitudes and appurtenances thereunto belonging, measuring one hundred twenty-seven and one-tenth (127.1) feet front on the north side of Public Highway, by a depth between parallel lines of two hundred (200) feet, and being bounded on the north by a Forty Foot Strip reserved by and belonging to vendor Laurence Robichaux Hebert, on the south by Public Highway, on the east by property formerly belonging to vendor Laurence Robichaux Hebert and sold to Oliver Andre, on the east by a forty foot strip of land reserved by and belonging to vendor Laurence Robichaux Hebert conveyed to Louis Hebert. The address of the property is given as 704 Hwy 90, New Iberia, LA 70560.
4. That tract assessed under Iberia Parish Assessors Parcel No. 0105283000 and further described as follows:
That certain tract of land, with all improvements thereon, situated in Ward 1 (formerly Ward 9) of Iberia Parish, Louisiana, in the Section 21, Township 12 South, Range 6 East, Iberia Parish, Louisiana, together with all rights, ways, servitudes and appurtenances thereunto belonging, fronting an angular 137.20 feet on the North side of Louisiana Department of Highways State Project No. 424-04-02, (immediately north of an adjoining Louisiana State Highway No. 14 right of way), by a depth between parallel lines of 200 feet and having a correspondingly angular rear line; Being bounded on the North by 50 private road, on the south by right of way of said Highway Department Project (State of Louisiana Project No. 424-04-02), on the east by Mrs. Laurence Robichaux Hebert or assigns, and on the west by Webster Hebert or assigns, all as per plat of survey by C. Howard Fenstermaker, Jr., dated December 20, 1963, attached to instrument recorded at Conveyance Book 444, folio 343, Entry No. 128214 of the records of Iberia Parish, Louisiana. The address of the property is given as 702 Hwy 90, New Iberia, LA 70560.
5. That tract assessed under Iberia Parish Assessors Parcel No. 0104316066 and further described as follows:
That certain tract of land, with all improvements thereon, situated in Ward 1 (formerly Ward 9) of Iberia Parish, Louisiana, in Section 21, Township 12 South, Range 6 East, Iberia Parish, Louisiana, together with all rights, ways, servitudes and appurtenances thereunto belonging, fronting 141.25 feet on the northerly side of U.S. 90 Frontage Road, by depth, between diverging lines, of 200 feet on each side, and having a width at the rear of 154.66 feet; bounded northerly and easterly by Private Road, southerly by U.S. Hwy 90 Frontage Road, and westerly by Oliver J. Andre, or assigns. The address of the property is given as 616 Hwy 90, New Iberia, LA 70560.
AND
WHEREAS in accordance with the provisions of La. R.S. 33:172, the City of New Iberia has published notice of the filing of the petition for annexation at least 10 days prior to the adoption of this ordinance.
AND
WHEREAS in accordance with the provisions of La. R.S. 33:172, the City of New Iberia desires to annex the area described above.
NOW THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the City of New Iberia, that:
Section 1: The preamble of this Ordinance hereinabove, and the findings therein, are hereby adopted.
Section 2: The following described property is hereby annexed into the corporate limits of the City of New Iberia:
That certain tract of land with all buildings and improvements thereon together with all rights, ways, privileges and servitudes thereto appertaining located in Section 21, Township 12 South, Range 6 East, Iberia Parish, Louisiana, containing 24.45 acres, more or less, bounded north by property of Emilda Babineaux Robichaux, or assigns, south by W Hwy 90 Frontage Road and property of Theodore A. Section 3: On the effective date of this ordinance, the boundaries of the corporate limits of the City of New Iberia are hereby changed to include the property described above, and all rights, privileges, duties and obligations, and all powers of whatsoever nature incident to the incorporation thereof, as set forth in the Charter of the City of New Iberia, Louisiana, and in the Constitution and laws of the State of Louisiana, shall apply to said property, its citizens and the City of New Iberia, Louisiana.
Section 4: The property annexed herein is adjacent to existing Voting District 3 and is hereby assigned to Voting District 3.
Section 5: The property annexed herein is given the zoning classification C-4 Highway Commercial District.
Section 6: This ordinance shall be published in full in the official journal of the City and shall become effective thirty (30) days after said publication. The City Clerk shall file with the Iberia Parish Clerk of Court a description of the entire boundary of the City as changed by this ordinance, which shall become the official boundary of the City on the effective date of this ordinance, and the added property be included within the boundaries of the City of New Iberia as provided in Sec. 1-104 of the Charter of the City of New Iberia.
Section 7: Be it further ordained that all laws or parts of laws in conflict herewith are repealed and/or amended.
Section 8: Be it further ordained this ordinance shall become effective upon promulgation as provided by law.
This ordinance having been introduced and placed on the agenda for public hearing, having submitted to a vote, was adopted by the following yea and nay votes:
