ARTICLE 596 NOTICE REGARDING
THE JEFFERSON PARISH LANDFILL PUTATIVE CLASS ACTION LAWSUIT
PLEASE READ THIS NOTICE CAREFULLY
Please take notice that on March 27, 2025, the United States District Court for the Eastern District of Louisiana, Judge Susie Morgan, DENIED Plaintiffs motion for class certification of their claims against Defendants Waste Connections Bayou, Inc., Waste Connections US, Inc., Louisiana Regional Landfill Company, and Aptim Corp. in Ictech-Bendeck v. Waste Connections Bayou, Inc., No. 2:18-cv-07889, which was consolidated with Thompson v. La. Regl Landfill Co., No. 18-cv-8071 (E.D. La.); Bernard v. Progressive Waste Sols. of LA, Inc., No. 18-cv-8218 (E.D. La.); Landry-Boudreaux v. Progressive Waste Sols. of LA, Inc., No. 18-cv-9312 (E.D. La.). This lawsuit pertains to odors allegedly emitted from the Jefferson Parish Landfill located at 5800 Highway 90 West, Avondale, LA 70094.
The Ictech-Bendeck and Bernard complaints, filed on July 25, 2018 and August 10, 2018 respectively, proposed the following class:
All persons domiciled of and/or within the Parish of Jefferson, . . . who sustained legally cognizable damages in the form of nuisance, interference with the enjoyment of their properties and/or diminution in value of their properties as a result of the Defendant(s) acts that caused the emission of noxious odors and gases into and unto their persons and properties.
The Thompson complaint, filed on July 30, 2018, proposed the following class:
All persons domiciled of and/or within the Parish of Jefferson on or after August 1, 2017 . . . , who sustained legally cognizable damages in the form of nuisance, trespass, interference with the enjoyment of their properties, and/or diminution in property value resulting from Defendants act that caused the emission of noxious odors into and unto their persons and properties.
The Landry-Boudreaux complaint, filed on August 28, 2018, proposed the following class:
All persons domiciled of and/or within the Parish of Jefferson, . . . , who sustained legally cognizable damages in the form of personal injury, lost wages, nuisance, interference with the enjoyment of their properties and/or diminution in value of their properties as a result of the Defendant(s) acts that caused the emission of noxious odors and gases into and unto their persons and properties.
Because the Court denied Plaintiffs motion for class certification, there are no longer any pending class actions against Waste Connections Bayou, Inc., Waste Connections US, Inc., Louisiana Regional Landfill Company, and Aptim Corp. related to alleged odors from the Jefferson Parish Landfill, and you cannot rely on a class action to protect any rights you may have in connection to this matter. Any individual who falls within the above class definitions and who wishes to pursue claims related to this matter must file a lawsuit.
You must act soon if you wish to file a lawsuit. Do not wait. Louisiana law limits the amount of time you have to file a lawsuit; 30 days after the first publication of this notice on May 3, 2025, the prescription period (or statute of limitations), which was suspended by the filing of the putative class action lawsuits, begins to run again as to everyone within the proposed class definitions pursuant to Article 596(A)(3) of the Louisiana Code of Civil Procedure. Failure to file a lawsuit may result in prescription of your right to file a lawsuit.
