NOTICE OF ADOPTION
The following ordinance, which was previously introduced in written form at a regular meeting of the New Iberia City Council on January 7, 2025, a summary thereof having been published in the official journal, together with a notice of public hearing which was held on January 23, 2025, in accordance with said public notice, was brought up for final passage on motion of David Merrill, and seconded by Troy Comeaux.
ORDINANCE NO. 2025-01
AN ORDINANCE AUTHORIZING THE MAYOR TO NEGOTIATE AND EXECUTE A COOPERATIVE ENDEAVOR AGREEMENT BY AND BETWEEN THE CITY OF NEW IBERIA AND HOSPITAL SERVICE DISTRICT NO. 1 FOR THE DISPOSAL OF A PARCEL OF PROPERTY IN THE SPANISH TOWNE CENTER SUBDIVISION IN EXCHANGE FOR CERTAIN PROPERTY TO BE USED AS ADDITIONAL ACCESS TO THE TECHE HAVEN SUBDIVISION
WHEREAS:
1. The City of New Iberia is the owner of the following described immovable property (hereafter the Spanish Towne Lot 16): That certain tract of land located in the City of New Iberia, Iberia Parish, Louisiana, situated in Sections 21 and 22, Township 12 South, Range 6 East, Iberia Parish, Louisiana, and being more particularly designated as LOT 16 OF SPANISH TOWNE CENTER COMMERCIAL DEVELOPMENT as depicted on the final plat of survey dated October 11, 2006, prepared by Wayne M. Labiche & Associates, LLC (the Subdivision Plat) and recorded under Entry No. 2006-13324 in the records of the Clerk of Court of Iberia Parish, Louisiana, and having such size, dimensions and other characteristics as are shown on the Subdivision Plat.
Being a portion of the property acquired by the City of New Iberia from Spanish Towne Investments, LLC by cash sale dated February 2, 2011, filed for record February 3, 2011 in Conveyance Book 1473, at Page 464, under File No. 2011-00001145, Iberia Parish public records.
2. The Spanish Towne Lot 16 has been vacant since its acquisition and the lot is not needed by the City of New Iberia for any public purpose.
3. The Spanish Towne Lot 16 has an appraised value of $93,000.00.
4. Hospital Service District No. 1 of Iberia Parish d/b/a Iberia Medical Center is the owner of the following described immovable property (hereafter the Hospital Tract): That certain tract of land located in the City of New Iberia, Iberia Parish, Louisiana, situated in Sections 20 and 21, Township 12 South, Range 7 East, Iberia Parish, Louisiana, measuring 50 feet front on the east side of N. Lewis Avenue by a depth between parallel lines of 476 feet more or less extending to property of Edward A. LaSalle, Jr., et als, the tract being bounded north by remaining property of Hospital Service District No. 1 of Iberia Parish d/b/a Iberia Medical Center, south in part by property of Bethel Church, Inc. and in part by property of Edward A. LaSalle, Jr., et als, east by property of Edward A. LaSalle, Jr., et als and west by N. Lewis Avenue. (survey pending) Being a portion of the property acquired by Hospital Service District No. 1 of Iberia Parish d/b/a Iberia Medical Center from Progressive Acute Care, L.L.C. by cash sale filed for record January 13, 2016 in Conveyance Book 1596, at Page 778, under File No. 2015-00000378, Iberia Parish public records.
5. The Hospital Tract has an appraised value of $71,000.00.
6. The City of New Iberia desires to acquire the Hospital Tract for the purpose of constructing a public street extending from N. Lewis Avenue to the adjacent property of Edward A. LaSalle, Jr., et als, which adjacent property is the site of a proposed residential development containing approximately 200 homesites. The proposed street is necessary for ingress to and egress from the proposed development, which will attract residents and result in increased property and sales tax revenues for the City of New Iberia. The benefits of the residential development that the exchange will make possible will more than offset the difference between the values of the two properties, resulting in equivalent value for the City of New Iberia.
7. Hospital Service District No. 1 of Iberia Parish d/b/a Iberia Medical Center is willing to exchange the Hospital Tract for the Spanish Towne Lot 16.
8. Where public entities may exchange properties by Cooperative Endeavor Agreement pursuant to Louisianas Local Services Law, La. R.S. 33:1324, as interpreted by Louisiana Attorney Opinion 14-0005.
THEREFORE, BE IT ORDAINED BY THE New Iberia City Council that:
Section 1: The Mayor of the City of New Iberia is hereby authorized to execute, on behalf of the City of New Iberia, a Cooperative Endeavor Agreement by and between the City of New Iberia and Hospital Service District No. 1 of Iberia Parish d/b/a Iberia Medical Center whereby the City will convey to Hospital Service District No. 1 of Iberia Parish d/b/a Iberia Medical Center the Spanish Towne Lot 16 described above in exchange for the Hospital Tract described above, such Cooperative Endeavor Agreement to contain such other terms and conditions as are approved by the Mayor.
Section 2: All ordinances or parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed.
Section 3: This ordinance shall become effective upon signature by the Mayor.
Section 4: If any clause, section or portion of this ordinance shall be declared illegal, null and void or unconstitutional by any court of competent jurisdiction, the remaining clauses, sections and portions shall remain in full force and effect, the provisions of this article or ordinance being severable.
This ordinance having been introduced and placed on the agenda for public hearing, having submitted to a vote, was adopted by the following yea and nay votes: YEAS: Brooke Marcotte, Warren White, Troy Comeaux, Ricky Gonsoulin, David Merrill, Ron Davis, and Dan Doerle NAYS: NONE. ABSENT: NONE. ABSTAIN: NONE. And this ordinance was declared adopted on this 23rd day of January, 2025, and effective upon signature of the Mayor on this 24th day of January, 2025.
