ORDINANCE NO. 049 OF 2024
AN ORDINANCE APPROVING A FULL REQUIREMENT
INCENTIVE AGREEMENT ("FRSA") BY AND BETWEEN LOUISIANA ENERGY AND POWER AUHOTRITY (LEPA) AND THE CITY OF NATCHITOCHES AND AUTHORIZING THE MAYOR OF THE CITY OF
NATCHITOCHES, RONNIE WILLIAMS, JR., TO
EXECUTE SAME
WHEREAS, the Louisiana Entergy and Power Authority (LEPA) was created pursuant to Chapter 10-A of Title 33 of the Louisiana Revised Statutes of 1950 (the "Act") to provide a means for those Louisiana cities which are members of LEPA to secure an adequate, reliable and economical supply of electric power and energy for their present and future needs; and
WHEREAS FURTHER, LEPA is empowered by the Act, The Local Services Law (hereinafter defined) and other constitutional and statutory authority supplemental thereto to: (i) acquire and construct facilities for the generation and transmission of electric power and energy, or to acquire an interest in an such facilities; (ii) purchase, sell, transmit or otherwise use electric power and energy within or without the State of Louisiana; and (iii) do all acts and things necessary to carry out the purposes and to exercise the powers granted to LEPA under the Act; and
WHEREAS FURTHER, the City of Natchitoches (MEMBER) has authority under the Act, Sub-Part A, Part VII, Chapter 2 of Title 33 of the Louisiana Revised Statutes of 1950, as amended ("The Local Services Law"), Sub-Part A, Part 1, Chapter 10 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority supplemental thereto, to undertake and implement the provisions of this Agreement; and
WHEREAS FURTHER, the CITY owns and operates an electric utility system, is a member of LEPA and is authorized under the Act and the laws of the State of Louisiana to contract and buy from LEPA power and energy required for its present and future requirements; and
WHEREAS, the Member owns and operates an electric utility system, is a member of LEPA and is authorized under the Act and the laws of the State of Louisiana to contract and buy power and energy required for its present and future requirements from LEPA; and
WHEREAS, the Member is not currently being serviced wholesale electricity under the LEPA Full Requirement Service Agreement ("FRSA") (hereinafter defined); and
WHEREAS, in order to secure an adequate, economical and reliable supply of electric energy for the Member's municipal electric system, LEPA and the Member have determined that LEPA will sell to the Member, and the Member will purchase from LEPA, all of the electric power and energy and transmission services required by Member for service to its native retail load on the terms and conditions set forth in the FRSA; and
WHEREAS, LEPA is a non-profit organization, therefore, all Existing FRSA Members (hereinafter defined) enjoy lower costs when a New FRSA Member (hereinafter defined) begins receiving power and energy from LEPA under the FRSA; and
WHEREAS, the Existing FRSA Members have agreed to share those savings with New FRSA Member(s);
WHEREAS FURTHER, a copy of the FRSA Agreement by and between Louisiana Energy and Power Authority and City of Natchitoches, Louisiana is attached hereto as Exhibit "A"; and
WHEREAS FURTHER, the City Council of the City of Natchitoches desires to continue its relationship with LEPA, approve the FRSA Agreement with LEPA and authorize the Mayor of the City of Natchitoches, Ronnie Williams, Jr., to execute same; and
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Natchitoches, Louisiana, in legal session convened, that the City of Natchitoches does hereby approve the FRSA Agreement by and between Louisiana Energy and Power Authority and City of Natchitoches, Louisiana attached hereto as Exhibit "A" and does further authorize and direct the Mayor of the City of Natchitoches, Louisiana, Ronnie Williams, Jr., to execute the FRSA Agreement by and between Louisiana Energy and Power Authority and City of Natchitoches, Louisiana, on behalf of the City of Natchitoches.
