The Livingston Parish Council met in a regular session duly called, advertised, and convened at its regular meeting place, at the Governmental Building in the Parish Council Chambers, located on 20355 Government Boulevard, Livingston, Louisiana, on Thursday, October 10, 2024, at the
hour of six o’clock (6:00) p.m. with the following Livingston Parish Council members present:

Due to the absence of the chair, the vice-chair assumed the duties as the presiding officer of the meeting.
The vice-chair called the meeting to order.
The vice-chair asked the public to please mute or turn off their cell phones.
The vice-chair announced that Public Input would be accepted from any member of the audience wishing to address an agenda item and explained the procedure to be called upon.
Councilman Joe Erdey called upon the vice-chair and stated that he would like to call a point of privilege please. The vice-chair granted his request.
Councilman Erdey called upon Parish Legal Advisor, Mr. Al Giraud, and asked as he was the Council’s attorney for that evening, he wanted to ask Mr. Giraud if hehad read the whole agenda and made sure that they were not having any open meeting law violations? He asked again if he had went over the agenda?
Mr. Giraud advised that yes, he had gone over the agenda, and he thought that they were fine.
Councilman Erdey asked Mr. Giraud if they were okay then for tonight, because he wanted to make sure that they were okay for tonight. He thanked Mr. Giraud.
The vice-chair addressed agenda item number 12, “Public Hearing andAdoption of L.P. Ordinance 24-29:An Ordinance to adopt a six (6) month Moratorium prohibiting the consideration or submittal of any preliminary plat for Residential Developments in CouncilDistrict 2 creating morethan five(5) lots – Ryan Chavers”, and advised that she wished to move this item up from its placement on the agenda. No one objected to this. She stated that this would be deferred until October 24th, 2024 and explained that Councilman Ryan Chavers was not able to attend the meeting that evening and he wished to bepresent forthe public hearing and adoption to beable to answer any questions if need be. He requested that this item be deferred, but the Council would still have the Public Hearing that had been scheduled because it had been advertised.

AN ORDINANCE TO ADOPT AN IMMEDIATE MORATORIUM PROHIBITING THE CONSIDERATION OR SUBMITTAL OF ANY PRELIMINARYPLATSFOR RESIDENTIAL DEVELOPMENTSINCOUNCIL DISTRICT2CREATING MORE THANFIVE (5)LOTSFOR APERIOD OF SIX MONTHS OR THE ADOPTION OF A COMPREHENSIVE NEW ZONING PROGRAM (WHICHEVER COMES FIRST)

The vice-chair asked if there were any other comment from the public. Having none, the vice-chair closed the Public Hearing.
Councilman John Mangus wished to ask the Parish attorney, Mr. Al Giraud, about the legality questions of individual Council Districts being zoned and others not. He asked could there be different zoning in each district as opposed to Parishwide?
Mr. Giraud advised that he thought that was a very broad question from a constitutional standpoint. He stated that the cleanest way to proceed would be for everything to be done uniformly and have a parish wide zoning plan in effect. He further stated that it was his understanding that this would not be the first district specific zoning that the Parish had passed. He conveyed that it had been done before there had been a precedent.

MOTION was offered by Dean Coates and duly seconded by Joe Erdey to defer the Public Hearing and Adoption of L.P. Ordinance24-29:“An Ordinanceto adopt asix (6)month Moratorium prohibiting the consideration or submittal of any preliminary plat for Residential Developments in CouncilDistrict 2 creating more than five (5)lots”, until the October 24, 2024 regular meeting of the Livingston Parish Council.

MOTION was offered by Billy Taylor and duly seconded by John Mangus to dispense with the reading of the minutes from the September 26, 2024 regular meeting of the Livingston Parish Council and adopt as written.

The vice-chair addressed agenda item number 10, “Parish President’s Report:” and was advised that Parish President Randy Delatte did not have anything to report at that time. She asked if anyone that
was in attendance from the Parish President’s office would like to share anything. No one did, and she then moved to thenext agenda item.
The vice-chair addressed agenda item number 11a, “Planning and Zoning Department: Highlandia Subdivision, 2nd Filing, located on Cane Market Road in Council District 3, Accept roads & improvements into the Parish Maintenance system, Release $157,714.00 maintenance bond.” She called upon Mr. Robert Dugas, Department of PublicWorks Director, to address this agenda item.
Mr. Dugas advised the Councilmembers that itwas the end of the maintenance period forthis agenda item.Hestated thattherehad only been one(1) comment reportedonthisdevelopment and ithad been addressed. It was his recommendation to accept the roads and improvements into the Parish Maintenance system and release the maintenance bond.
LPR NO. 24-366
MOTION was offered by Billy Taylor and duly seconded by Lonnie Watts to accept the roads and improvements into the Parish Maintenance system and release the one hundred fifty-seven thousand five hundred fourteen dollars ($157,514.00) maintenance bond for Highlandia Subdivision, 2nd Filing, located on Cane Market Road in Council District 3.

Thevice-chairaddressed agendaitem number13,“Adoptresolution ratifying the intent of the adoption of the Health Unit millages of the September 19, 2024 regular meeting of the Livingston Parish Council”, and called upon CouncilmanRicky Goff who explained the mis-step that had been made at the September 19, 2024 regular meeting of the Livingston Parish Council when the Health Unit millages were adopted. He advised that this resolution would offer what was the intent of the LivingstonParish Council members when they adopted the millages for the Livingston Parish Health Unit. Hestated that the millages were to be set at 1.5.
Councilman Goff asked the Council members to cast their vote again that evening to recognize the fact that itwas theirintent in the previouspublichearing and ordinance. Hestated that the next agenda item following the current item would be going a little bit further by introducing an ordinance and readvertising for the public hearing, having just enough timeto go through the legal process again.
LPR NO. 24-367
MOTION was offered by Ricky Goff and duly seconded by John Mangus confirming the intent of the Livingston Parish Council at their September 19, 2024 regular meeting to amend the Health Unit millages from 2.5 mills to 1.5 mills for the tax year of 2024, then adopting the ordinance as amended to levy adjusted millage rates after reassessment and roll forward the millage rates not to exceed the prior years maximum rate for the tax year 2024.

The vice-chair addressed agenda item number 14, “Introduction of ordinance:An Ordinance to levy adjusted millage rates after reassessment and roll back the millage rates not to exceed the prior year’s maximumrate for the Health Unit for theTax Year 2024”, and requested theCouncil clerk to read the proposed ordinance by title as follows:

Councilman John Mangus made the motion and Councilman Billy Taylor wished to second that motion. The vice-chair asked if anyone had any comments that they wished to be addressed. Having none, the vice-chair called for the vote.

MOTION was offered by John Mangus and duly seconded by Billy Taylor to publish the ordinance by title in the Official Journal and set a Public Hearing for Thursday, October 24, 2024, at the hour of six o'clock (6:00) p.m. at the Governmental Building in the Livingston Parish Council chambers located at Government Boulevard, Livingston, Louisiana, at which time comments will be received on the proposed ordinance prior to a Council vote.

The vice-chair addressed agenda item number 15, “Adopt a resolution to name an unnamed road, “Peacock Drive”, located off Cane Market Road in Council District 1”, and called upon Councilman Lonnie Watts.
Councilman Lonnie Watts advised that this is located on a private road and the property owners and residents have petitioned and met all of the requirements to have it named for 911 purposes.

MOTION was offered by Lonnie Watts and duly seconded by John Mangus to name an unnamed road, “Peacock Drive”, for 911 purposes being located off of Cane Market Road in Council District 1, as approved in writing on October 3, 2024 by the Livingston Parish Assistant Permit Director/Address Coordinator.

Thevice-chair addressed agendaitem number1, “Adopt aresolution toauthorize awaiverof Section 125-37(6),“Requirements forMinor Subdivisions”,toallowafifty(50)footservitudelocated off Cane Market Road, in Council District 1”, and called upon Councilman Lonnie Watts.
Councilman Lonnie Watts explained that theproperty owners had requested this soitwould give them access to the property.
Thevice-chair asked if there were any questions from the audience or the Councilmembers. Having none, Councilman Watts stated that he wished to make the motion and Councilman John Mangus advised that he wished to second thatmotion.
Councilman Dean Coates informed the vice-chair that he had a comment. He questioned Councilman Watts about the request to grant a waiver for a fifty (50’) foot servitude. Councilman Watts stated that the property was fourteen (14)acres in total and the waiver request was toallow them to get justpast the house. Councilman Coates asked if itwas inan existing neighborhood. Councilman Watts stated that it was not. Councilman Coates called upon Mr. Robert Dugas, Department of Public Works Director, and asked him if he had any information on this request. He further stated that the question that hehad concern with, was what the ordinance indicated, being that the servitudes need to be sixty (60’) feet to beaccepted by the parish unless the ditches are covered.
Mr. Robert Dugas, Department of Public Works Director, approached the podium as requested by Councilman Coates and addressed the Council members. He stated that the current ordinance allows for a fifty (50’) foot servitude if it is subsurface or curb and gutter. He reiterated that the property owner could have a fifty (50’) foot servitude if they had subsurface in that area. He stated that the problem with fifty (50’) feet was that you did not have enoughof the road,the shoulder, theditch and everything else.
Mr. Dugas advised if they were going to have afifty (50’) foot servitude, his recommendation would be to require them to make sure that it is curb and gutter. Then it would fall within the development code and the waiver would not be needed. He said that the problem that he wished to point out and that he had to question with a waiver, is that if it ever became a public road, then the Parish would have a public road with afifty (50’) foot right-of-way. Hefurther stated that it was probably not their intent now, but he could tell them now that the Parish had plenty of roads that the intent was not to be a public road when they started.
Councilman Lonnie Watts asked the Council members if he could reach out the property owners that were requesting this waiver to advise of Mr. Dugas’s recommendation and see what they wanted to do.
Councilman John Mangus asked if it was just the one (1) property that needed the fifty (50’) feet?
Councilman Watts replied that the way that he understood it, that there was just a one hundred fifty (150’) foot section of the servitude that was fifty (50’) feet wide and then it opened back up to sixty (60’) feet. He explained that they had sixty (60’) feet throughout the servitude with the exception of that first entrance going in and there was a house positioned there that stopped the servitude from being sixty (60’) feet.
Councilman Joe Erdey asked Councilman Watts if he could get that arranged for the curb and gutter please if that was possible. Councilman Watts replied that hedid not know. Thevice-chair requested if Councilman Watts could pull this agenda item back and then speak with his constituent about the
curb and gutter and come back to the Council. Councilman Watts was agreeable and advised that he did not mind doing that. Mr. Dugas came back to thepodium and addressed Councilman Watts. He stated that he was going to get a little bit creative in the way that he explained what he wanted to say next.
Mr. Dugas explained that as long as it was not an open ditch when it is drawn up and it is a fifty (50’) foot servitude that is acting like a curb and gutter, it doesn’t mean that it has to have subsurface if the drainage doesn’t allow for it. He wished to reiterate that he wanted Councilman Watts to be careful when considering giving fifty (50’) feet, because they did not want to end up with some open ditches inafifty (50’)foot servitude, but if it allowsforthe drainagein theroad andthe ditch is not necessary, there is no reason for an open ditch to be there, so you could consider that as your “subsurface”. He encouraged Councilman Watts to call him the following week so that they may discuss it further.
The vice-chair asked if Councilman Watts would like to change his motion and make it a motion to defer?
CouncilmanWatts was agreeable and stated that he wished to defer this agendaitem until the Council could find out more information. Councilman Mangus made the second to this motion.

MOTION was offered by Lonnie Watts and duly seconded by John Mangus to defer the authorization of a waiver request of Section 125-37(6), “Requirements for Minor Subdivisions”, that wouldallowafifty(50)footservitude located off CaneMarket Road, in CouncilDistrict 1, so that more information may be obtained for the Council members to make a decision to grantand allow the waiver request.

All meetings of the Livingston Parish Council are open to the public and are held in the Livingston Parish Governmental Building, located in the Council Chambers, 20355 Governmental Boulevard, Livingston, LA.
Upon being submitted to a vote, the vote thereon was as follows:
YEAS: MS. SANDEFUR, MR. GOFF, MR. MANGUS, MR. COATES, MR. WATTS, MR. TAYLOR, MR. ERDEY

Thereupon the vice-chair declared that the Motion had carried and was adopted on October 10, 2024.
The vice-chair addressed agenda item number 20a, “Committee Report(s): Finance Committee”, and called upon Councilman John Mangus, Finance committee chairman.
Councilman Mangus advised that the Finance committee had a busy committee meeting and learned a lot. He stated that they had learned about beaver trapping and liability insurance for Council members.
He invited Mr. David Hooter, Director of Human Resources in Administration, to the podium to discuss the insurance topic. Councilman Mangus indicated that there had been a recommendation from the Finance committee that the Council members accept the insurance quote of nineteen thousand four hundred and twenty dollars ($19,420.00).
Mr. Hooter addressed the Council members and wished to inform them that the quote that was received and presented was foran annual policy. In addition, he stated that this insurance extends to othermembers other than the Council, others in the Parish President’s office, some boards and otherentities that the Parish Council has commissioned to. Hefurther explained that it was akind of umbrella to others besides the Parish Council. The Council members thanked Mr. Hooter.
LPR NO. 24-378
MOTION was offered by John Mangus and duly seconded by Billy Taylor to accept the recommendation of the Finance committee to approve the quote received for Public Officials’Liability Insurance in the annual amount of nineteen thousand four hundred twenty dollars ($19,420.00) and authorize the Parish President and his Administration to execute the necessary documentation to acquire this insurance.
Upon being submitted to a vote, the vote thereon was as follows:

Mr. Mickey McMorris,Parish FinanceDirector, addressed the Councilmembers and presented the first draft of the proposed2025 Budget whereby complying withSection 5-02, “Operating Budget Preparation andAdoption”ofthe Livingston Parish Home Rule Charter.
No action was taken at thattime.
The vice-chair addressed agenda item number 20b, “Committee Report(s): Ordinance Committee: Recommendation(s) of Ordinance introduction(s)”, and called upon Councilman Dean Coates, Ordinance committee chairman.
Councilman Coates advised that the committee did not have much at their past Ordinance committee meeting, being one(1)item and that item came upearlier during the Council meeting and was passed. He wished to encourage everyone that if they had any ordinances, bring them to the Ordinance committeesothat they can try to vet those beforethey reach theCouncilmeeting. Hewishedto extend this invitation to the public as well.
The vice-chair addressed agenda item number 21, “District Attorney’s Report:” and called upon Mr. Al Giraud. Mr. Giraud advised that there was nothing to report that evening.
The vice-chair thanked Mr. Giraud and asked if any of the Council members had any Councilmen’s comments?
The vice-chair advised that she did have a few things that she wished to address and comment upon. Shebegan by announcing thatthere would be aTrunk-or-Treat event in her Councildistrict located at South Park addressed at 7510 Vincent Road on October 27th.
ShefurtherdeclaredthattheTrunk-or-Treateventthis yearwouldhavesomeprettyexciting additions. She advised that the invitation was extended and available for all of the children up to age seventeen (17). She stated that the park is doing anew event earlier that day called “Jamming in the Park”, that will be held on October 27th from 3:00 p.m. to 6:00 p.m. It will be a family event and a band will be playing, there will be food trucks and it will be lots of fun. She invited everyone to attend.
The vice-chair also wished to recognize and announce the Parish Council’s annual Christmas card contest. She explained that this is something that the Parish Council does every year involving the art studentsthroughoutthe Parish to participatein.Sheannounced thatthe school artteachers in the Parish willbe receiving information in the mail and advised that they could contact the Councilofficeif they needed further information. Shestated that the winner would be announced at the December 5, 2024 regular meeting of the Livingston Parish Council and they will also be recognized and presented with the Johnny F. Bell ArtisticAchievement Awardcertificateand given awinning prizefrom themembers of the Council.
Councilman Dean Coates wished to make an announcement that the Livingston Parish Republican ExecutiveCommitteewould beholding adonation event along with the Livingston Parish Republican Women. They will be meeting on Tuesday, October 22nd at the Sam’s Club in Denham Springs accepting donations and trying to bring those to Florida and to the areas affected by the two (2)recent hurricanes. He stated that if anyone would like to make a monetary donation, they could look on the social media pages for the Livingston Parish Republican Women or the RPEC and there will be a VENMO option for monetary donations. If not, he instructed to go do your grocery shopping on Tuesday, the 22nd and they will have trailers out there ready to load up. He stated that they will probably be leaving two (2) days after that for delivery. Councilman Coates thanked everyone and asked for them to just keep that in mind.
Councilman Lonnie Watts reportedthat the87thLivingston Parish Fair was being held at that time and would continue until Sunday. He invited everyone to come out and participate.
Before adjournmentof themeeting,thevice-chair wished to “plug”the Denham Springs FallFest that she attended the previous weekend. She surmised that it had the largest crowd and participants that she had ever encountered. It was deemed to be a really successful event and there would be another oneheld in the spring.
Having no further business, a motion to adjourn was requested until the next regular meeting of the Livingston Parish Council scheduled on Thursday, October 24, 2024 at the hour of six o’clock (6:00)
