SUCCESSION OF KARL DEAN SISEMORE, PROBATE DOCKET NO. 7920, SECOND JUDICIAL DISTRICT COURT, JACKSON PARISH, LOUISIANA. NOTICE is hereby given that Leslie Sisemore Saucier, the Administratrix of this Succession, has petitioned the Court for authority to sell the movable property of the Succession of Karl Dean Sisemore listed on the attached Exhibit A at a public auction held on Estate premises and conducted by Dance Auction Company, (Ben Dance, Louisiana Auctioneer's License number 1559-24) (“Auctioneer”), to conduct the public auction sale pursuant to the terms and conditions set forth in the contract attached to this Petition as Exhibit B; (3) place reserve prices on such items as she deems advisable; (4) execute the sales contract with Auctioneer and any other reasonably necessary documents; (5) take all other actions reasonably necessary to accomplish such sale; (6) conduct the auction at the Estate premises on a date to be agreed upon by Petitioner and Auctioneer; and, (7) the Estate's sole warranty to the sellers shall be a warranty of good and merchantable title, free and clear of any liens or encumbrances, and all items shall be sold on an “as is, where is” basis and the purchasers shall remove their purchased items within 24 hours of the conclusion of the sale. EXHIBIT B, Auction Contract, Personal Property-Agreement made this _ day of _ , 2024 between the Estate of Karl Dean Sisemore, hereinafter called Seller, and Dance Auction Company, herein after called Auctioneer. The Auctioneer hereby agrees to use his professional skill, knowledge and experience to the best advantage of both parties in preparing for and conducting the sale. The Seller hereby agrees to turn over and deliver to the Auctioneer, to be sold at public auction the items listed in Exhibit A. No item shall be sold or withdrawn from the sale prior to the auction except by mutual agreement between Seller and Auctioneer. If the item is sold or withdrawn, the Auctioneer shall receive a full commission on the item. The auction is to be held at 836 Homer Sisemore Road, Clay, Louisiana on the _ day of _ , 2024. In case the sale is postponed due to inclement weather, said auction will take place on a later date agreeable to both parties. It is agreed that all said goods be sold to highest bidder, with the exception of items specified by Seller in writing to be protected. Auctioneer shall receive full commission on any item withdrawn from sale. It is further mutually agreed that the Auctioneer may deduct his fee at set below from the gross sales receipts resulting from said auction sale. The Auctioneer agrees to turn net proceeds from sale over to Seller immediately following auction, along with sale records and receipts. The Seller agrees that all Auctioneer's commission and Seller's expenses listed below shall be deducted from the gross sales receipts. The Seller covenants and agrees that he has good title ad the right to sell and said goods are free from all liens and encumbrances. Seller agrees to provide merchantable title to all items sold and deliver title to the purchasers. Seller agrees to hold harmless Auctioneer against any claims the nature referred to in this contract. Seller shall pay Auctioneer the following: (1) 15% commission on gross sale receipts; (2) $150.00 advertising charge; and (3) $250.00 for sale computer services. Additional terms: (1) Seller will all items on Exhibit A on an “as is, where is” basis, with no warranty of fitness; and (2) purchasers shall remove their purchased items from the sale premises within 24 hours of the conclusion of the sale, at purchasers' expense.
