Notice of Petition to Sell Real Estate at Private Sale
Notice is hereby given that Danny L. Richard and Debra Richard LeJeune the duly appointed, qualified and acting co-administrators of the above entitled and numbered succession have pursuant to the provisions of the Code of Civil Procedure, Article 3281, et seq, petitioned the 15th Judicial District Court, Acadia Parish, for authority to sell at private sale, for the prices set forth following each description, payable in cash, and pursuant to the terms set forth hereinafter, the following described properties belonging to the succession of Marie Richard captioned above:
A. This property bears municipal address 511 SW Court Circle, Crowley, Louisiana and is more particularly described as follows:
That certain tract of land, together with all buildings and improvements situated thereon described as Lot Fourteen (14) Block Seventy-Eight (78) City of Crowley, La.
Being the same property acquired by Daniel G. Richard in that certain Act of Cash Sale dated March 7, 1990 and recorded in Conveyance Office Book V48 at Page 0115 of the records of the Clerk of Court of the Parish of Acadia.
Also being the same property acquired by the Estate of Marie Hebert Richard in that certain Consent Judgment of Partition dated April 28, 2011 it the matter entitled “Daniel George Richard versus Marie Hebert Richard” on the docket of the 15th Judicial District Court for the Parish of Acadia, Louisiana, and recorded under entry number 815997 of the conveyance records of the Clerk of Court for the Parish of Acadia.
This property will be sold for $80,000 cash pursuant to the terms set forth hereafter.
B. This property bears municipal address 570 NE Court Circle, Crowley, Louisiana and is more particularly described as follows:
That certain lot or parcel of ground, together with all buildings and improvements thereon situated, situated in the City of Crowley, Acadia Parish, Louisiana, known and described as Lot Twenty (20) of Block Ninety-two (92), as per plat of said city on file in the office of the Clerk of Court for Acadia Parish, Louisiana.
Being the same property acquired by Daniel G. Richard and Marie Ruby H. Richard in that certain Act of Cash Sale dated August 12, 1993 and recorded in Conveyance Book L51 at Page 0329 of the records of the Clerk of Court for the Parish of Acadia.
Also being the same property acquired by the Estate of Marie Hebert Richard in that certain Consent Judgment of Partition dated April 28, 2011 it the matter entitled “Daniel George Richard versus Marie Hebert Richard” on the docket of the 15th Judicial District Court for the Parish of Acadia, Louisiana, and recorded under entry number 815997 of the conveyance records of the Clerk of Court for the Parish of Acadia.
This property will be sold for $75,000 cash pursuant to the terms set forth hereafter.
C. This property bears municipal address 123 E Ash, Crowley, Louisiana and is more particularly described as follows:
That certain tract or parcel of ground together with all buildings and improvements thereon, being more particularly described as the West fifty (50’) feet of Lots 13 & 14 and the West fifty (50’) feet of the South 20 feet of Lot 12 of Block 44 of the town of Crowley, Acadia Parish, Louisiana.
Being the same property acquired by Daniel G. Richard and Ruby H. Richard in that certain Act of Cash Sale dated May 8, 2002 and recorded in Conveyance Book X58 at Page 276 of the records of the Clerk of Court for the Parish of Acadia.
Also being the same property acquired by the Estate of Marie Hebert Richard in that certain Consent Judgment of Partition dated April 28, 2011 it the matter entitled “Daniel George Richard versus Marie Hebert Richard” on the docket of the 15th Judicial District Court for the Parish of Acadia, Louisiana, and recorded under entry number 815997 of the conveyance records of the Clerk of Court for the Parish of Acadia.
This property will be sold for $45,001 cash pursuant to the terms set forth hereafter.
D. This property bears municipal address 1429 S. Ave F, Crowley, Louisiana and is more particularly described as follows:
An undivided one-half ½ interest in and to a certain tract or parcel of land, together with all buildings and improvements situated thereon, known and described a tract of land measuring 100 feet by 142 feet in the Ellis Keller Subdivision, located in Section 4, Township 10 South, Range 1 East, Acadia Parish, Louisiana.
Being the same property acquired by Daniel G. Richard and Chester Cormier in that certain tax sale dated June 5, 1991 and recorded in Conveyance Book S49 at Page 0048 of the records of the Clerk of Court for the Parish of Acadia.
Also being the same property acquired by the Estate of Marie Hebert Richard in that certain Consent Judgment of Partition dated April 28, 2011 it the matter entitled “Daniel George Richard versus Marie Hebert Richard” on the docket of the 15th Judicial District Court for the Parish of Acadia, Louisiana, and recorded under entry number 815997 of the conveyance records of the Clerk of Court for the Parish of Acadia.
This property will be sold for $56,000 cash pursuant to the terms set forth hereafter.
CAVEAT: THE ESTATE OF MARIE RICHARD OWNS ONLY AN UNDIVIDED ONE-HALF OF THIS PROPERTY, THE OTHER UNDIVIDED ONE-HALF IS OWNED BY THE ESTATE OF ELVIA CORMIER, THE HEIRS OF WHICH AGREE TO SELL THEIR HALF INTEREST TO THE BUYER FOR HALF OF THE $56,000 PROCEEDS OR $28,000.
E. This property bears municipal address 914 S. Ave G, Crowley, Louisiana and is more particularly described as follows:
Those certain lots of parcels of ground located in the South Crowley Addition to the City of Crowley, Acadia Parish, Louisiana, together with all buildings and improvement thereon situated, known and described as Lot Eleven (11) and the East Eighty-Two feet (E 82’) and North Twenty feet (N 20’) of the West Fifty Feet (W 50’) of Lot Twelve (12) of Block Forty-Four (44) of said addition as per plat on file and of record in the office of the Clerk of Court, Acadia Parish, Louisiana.
Being the same property acquired by Daniel G. Richard and Ruby Hebert Richard in that certain Act of Cash Sale dated July 14, 1995 and recorded in Conveyance Book 1153 at Page 0424 of the records of the Clerk of Court for the Parish of Acadia.
Also being the same property acquired by the Estate of Marie Hebert Richard in that certain Consent Judgment of Partition dated April 28, 2011 it the matter entitled “Daniel George Richard versus Marie Hebert Richard” on the docket of the 15th Judicial District Court for the Parish of Acadia, Louisiana, and recorded under entry number 815997 of the conveyance records of the Clerk of Court for the Parish of Acadia.
This property will be sold for $46,001 cash pursuant to the terms set forth hereafter.
F. This property bears municipal address 810 S. Ave D, Crowley, Louisiana, and is more particularly described as follows:
Two certain lots or parcels of ground, together with all buildings and improvement thereon, situated in the City of Crowley, Acadia Parish, Louisiana, and more particularly identified as the East Half (E1/2) of Lots Ten (10) and Eleven (11) of Block Thirty-five (35) of the South Crowley Addition to the City of Crowley, Acadia Parish, Louisiana, as per plat of said addition on file and of record in the office of the Clerk of Court of Acadia Parish, Louisiana.
Being the same property acquired by Daniel G. Richard and Ruby Hebert Richard in that certain Act of Cash Sale dated December 22, 1995 and recorded in Conveyance Book P53 at Page 0937 of the records of the Clerk of Court for the Parish of Acadia.
Also being the same property acquired by the Estate of Marie Hebert Richard in that certain Consent Judgment of Partition dated April 28, 2011 it the matter entitled “Daniel George Richard versus Marie Hebert Richard” on the docket of the 15th Judicial District Court for the Parish of Acadia, Louisiana, and recorded under entry number 815997 of the conveyance records of the Clerk of Court for the Parish of Acadia.
This property will be sold for $17,000 cash pursuant to the terms set forth hereafter.
The sales will be for cash payments at the time of closing. Furthermore, the prospective buyers have performed all inspections and due diligence prior to making their offers or waived same, and the buyers acknowledged that each respective offer was not conditioned on financing or appraisal. Each buyer acknowledged they had cash readily available to close the sale. The buyers also acknowledged the proposed sale was based upon the property’s current condition and that the Seller was not bound to make any repairs. Buyers also acknowledged that the sale was without any warranties and that the property will be sold in “AS IS” condition, with each Buyer waiving, releasing and relieving Seller from any claims or causes of action in redhibition or for reduction of the purchase price pursuant to Louisiana Civil Code Articles 2520, et seq, and 2541, et seq, and Buyers further acknowledged that the sale(s) would be without any warranty of fitness for ordinary or particular use pursuant to Louisiana Civil Code Article 2524. Prospective buyers also acknowledged that the aforesaid language would be included in the Act of Cash Sale, and thus their offers were only conditioned on the advertisements required by law and authority of the Court authorizing the Succession Representatives to execute the respective sales.
NOW, THEREFORE in accordance with the law made and provided in such cases, notice is hereby given, that Danny L. Richard and Debra Richard LeJeune the duly appointed, qualified and acting co-administrators of the above entitled and numbered succession, propose to sell the aforesaid immovable property, at private sale, for the prices and upon the terms aforesaid, and the heirs, legatees and creditors are required to make opposition, if any they have or can, to such course, within 7 days including Sundays and holidays, from the day whereon the last publication of this notice appears.
This notice is being published 2 times, once approximately 20 days before the commencement of the 10-day period to make opposition and one additional time approximately 1 day before the commencement of the 10-day period to make opposition. Opposition may be filed at any time before expiration of the 10-day period from the day whereon the last publication of this notice appears.
