CITY OF PINEVILLE NOTICE OF ADOPTION OF ORDINANCE Notice is hereby given that the following ordinance was adopted at a public hearing of the Pineville City Council on Tuesday, October 10, 2023 and laid over for publication of notice, to wit: ORDINANCE NO. 2023-327 AN ORDINANCE TO AMEND THE ZONING CLASSIFICATION OF A PARTICULAR PARCEL OF IMMOVABLE PROPERTY LOCATED WITHIN THE CITY LIMITS OF THE CITY OF PINEVILLE, LOUISIANA WHEREAS, in accordance with the Louisiana Law, a petition has been presented to the Mayor and Council of the City of Pineville, Louisiana, by the owner of a certain parcel of immovable "Property" for a reclassification of the zoning of said Property from R-1 (Residential) to C-3 (Commercial); and WHEREAS, notice of said petition has been given by publication in The Town Talk on the 20th day of September, 2023; on the 27th day of September, 2023; and on the 4th day of October, 2023; and WHEREAS, the Zoning Commission for the City of Pineville has convened on the 10th day of October, 2023, with a majority of the members of the Commission voting in approval of the requested reclassification. NOW THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of Pineville, Louisiana in legal session convened, and after a public hearing held this date, that: I The zoning classification of the described Property (formerly R-1) is hereby amended to C-3 in accord with Section I above. The description of the said Property is as follows: One (1) certain lot or parcel of ground, together with all the buildings and improvements thereon, situated in the Parish of Rapides, State of Louisiana, in that subdivision known as Jefferson Heights Addition to the City of Pineville, as per Plat recorded in Plat Book 4, Page 5, of the records of the Parish of Rapides, being designated as Lot One (1) and more clearly shown by Certificate of Survey by Daniel D. Sanderfur Inc, dated April 13, 1984, outlined in red and paraphed "Ne Varietur" for identification with an Act of Dation En Paiement, recorded in COB 1324, Page 464, Entry # 916709, official records of the Parish of Rapides, Louisiana; said Lot having such dimensions as shown on said map and subject to such servitudes of records and as shown on said map, a copy of which is attached hereto and incorporated herein. Property description taken from Conveyance Book 1384, Page 69. Less and Except: One (1) certain tract(s) or parcel(s) of land, together with all the improvements situated thereon, and all of the rights, ways, privileges, servitudes and advantages thereunto belonging or in anywise appertaining, situated in Section(s) 20, Township 4 North, Range 1 West, Land District North of the Red River, Rapides Parish, Louisiana, identified as Parcel No(s). 3-1 as shown on Sheet No(s). 3, on the property map for State Project No. 015-01-0040, F.A.P. No. STP-7800(004), KCS Railroad Underpass Improvements, (Pineville), Route No. US 165 (BUS), Rapides Parish Louisiana, prepared by William J. Wood, Jr., Professional Land Surveyor, dated 2-24-98 and most recently revised 4-23-99, said map being attached hereto and made a part hereof, which property is more particularly described as follows: Parcel No. 3-1, From a point on the centerline of State Project No. 015-01-0040, at Station 101+48.201, proceed N40º37'01"W a distance of 9.587 meters to the point of beginning; thence proceed N40º37'01"W a distance 2.529 meters to a point and corner; thence proceed along a curve to the left having a radius of 272.000 meters, whose length is 53.865 meters and whose chord length is 53.777 meters and bears N18º23'27"E to a point and corner; thence proceed along a curve to the left having a radius of 293.149 meters, whose length is 69.693 meters and whose chord length is 69.529 meters and bears N05º54'25"E to a point and corner; thence proceed N86º41'39"E a distance of 1.672 meters to a point and corner; thence proceed S0118'46"W a distance of 33.737 meters to a point and corner; thence proceed along a curve to the right having a radius of 295.438 meters, whose length is 36.524 meters and whose chord length is 36.500 meters and bears S09º10'34"W to a point and corner; thence proceed along a curve to the right having a radius of 274.289 meters, whose length is 55.398 meters and whose chord length is 55.304 and bears S18º30'14" to the point of beginning. All of which comprises Parcel 3-1 as shown on sheet 3 of the right of way plans of State Project No. 015-01-0040 and contains an area of 263.88 square meters or 2840.4 square feet. Concomitant with the sale and transfer of the herein above described property, vendor does also grant unto department One (1) temporary construction servitude(s) on, over and across vendor's property to accommodate construction of the said State Project No. 015-01-0040, and which temporary construction servitude(s) is described as follows: Parcel No. 3-1-C-1, From a point on the centerline of State Project No. 015-01-0040, at station 101+48.201, proceed N40º37'01"W a distance of 12.116 meters to the point of beginning; thence proceed N40º37'01"W a distance of 4.433 meters to a point and corner; thence proceed N23º01'40"E a distance of 35.885 meters to a point and corner; thence proceed S50º13'11"E a distance of 2.185 meters to a point and corner; thence proceed along a curve to the right having a radius of 272.000 meters, whose length is 37.300 meters and whose chord length is 37.271 meters and bears S20º08'07"W to the point of beginning. All of which comprises parcel 3-1-C-1 as shown on sheet 3 of the right of way plans of State Project No. 015-01-0040 and contains an area of 125.50 square meters or 0.013 hectare or 1350.9 square feet or 0.031 acre. A description of the boundaries of the Property described herein and the C-3 zoning classification shall be recorded by the Pineville City Clerk with all appropriate State, Parish, and City officials within ten (10) days from the adoption hereof. III. That this Ordinance be published once in THE TOWN TALK, a newspaper having a general circulation in the City of Pineville, and that thirty (30) days after the date of said publication, this Ordinance shall become operative in accordance with Louisiana Law. IV. It is the intention of the governing body that all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. The following members of the Council voted as follows -- YEAS: Councilpersons Galloway, Dorn, Frederic, Bouchie, Martin. NAYS: NONE. Whereupon, this motion receiving the affirmative vote of a majority of the members of the Council, the presiding officer declared the above Ordinance duly adopted on this 10th day of October, 2023.
