5766704 RESOLUTION NO. 15 OF 2023 BY THE CADDO-BOSSIER PARISHES PORT COMMISSION: A RESOLUTION RATIFYING THE EXECUTIVE PORT DIRECTOR'S EXECUTION OF A CERTAIN LEASE AGREEMENT OF PROPERTY OWNED BY THE CADDO-BOSSIER PARISHES PORT COMMISSION, AND TO OTHERWISE PROVIDE WITH RESPECT THERETO WHEREAS, the Caddo-Bossier Parishes Port Commission (the "Commission") is the governing body and owner of an Industrial Park located in Caddo and Bossier Parishes; WHEREAS, under the provisions of La. R.S. 34:3160, the Commission is authorized to sell, lease, or otherwise dispose of lands, buildings or other property to any enterprise locating or existing within the Port area; WHEREAS, the Commission owns a tract of land commonly referred to as the Slack Water Harbor, located in Caddo Parish, Louisiana (the "Leased Premises"), which contains a 400' by 225' area tract of land; WHEREAS, the Commission desires to provide Berard Transportation, Inc., (the "Lessee") access to the Leased Premises solely to transport specialty cargo for industrial and commercial purposes; WHEREAS, the Commission entered into a Lease Agreement with the Lessee dated June 23, 2023 to lease the above-described tract of land; WHEREAS, the term of the Lease Agreement shall be for a period of one (1) year with an option to renew upon its expiration; WHEREAS, as consideration for entering into the Lease Agreement, the Lessee will pay the Commission the sum of Ten Thousand and No/100 ($10,000.00) Dollars per month throughout the term of the Lease Agreement and other compensation related to dredging the channel of the Leased Premises. NOW THEREFORE, BE IT RESOLVED by the Caddo-Bossier Parishes Port Commission, in legal and regular session convened, that it hereby ratifies the execution of the Lease Agreement between the Commission and the Lessee dated June 23, 2023, by Eric England, the Executive Port Director. BE IT FURTHER RESOLVED that this Resolution shall be published in the official journal of the Commission in accordance with the provisions of La. R.S. 34:3160(D)(3). BE IT FURTHER RESOLVED that this Resolution shall become effective immediately upon its adoption. BE IT FURTHER RESOLVED, that if any provision or item of this Resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items, or applications of this Resolution which can be given effect without the invalid provisions, items, or applications, and to this end the provisions of this Resolution are hereby declared severable; and BE IT FURTHER RESOLVED that all Resolutions or parts thereof in conflict herewith are hereby repealed.
