AN ORDINANCE TO AMEND CHAPTER 41
ARTICLE I, SECTION
41-2(a) OF THE BERNICE
MUNICIPAL CODE
PERTAINING TO WATER,
SEWER AND GARBAGE RATES AND (b) (3)
PERTAINING TO
RECONNECT FEES
WHEREAS, The Town of Bernice Water System needs to raise its water rates necessary to maintain reserve accounts to take care of future repairs and
WHEREAS the current rates are insufficient to service bonds, fully provide for the cost of operation of the water, sewer and garbage services and a study of the current number of users and average usage by the Louisiana Rural Water Association revealed the water system was not sustainable at current rates to provide adequate funding for operations, bond maintenance, and reserve accounts.
THEREFORE, The Council for the TOWN OF BERNICE desires to Amend the Water, Sewer and Garbage rates for the TOWN OF BERNICE.
BE IT ORDAINED that Chapter 41, Article I, Section 41-2(a) of the BERNICE MUNICIPAL CODE is amended as follows, to-wit:
Sec. 41-2. Utilities rates; penalties, interest and fees.
(a) The rates, charges and deposits, in connection with water, sewer and garbage services provided by the town, are hereby established:
WATER:
** RESIDENTIAL RATES
$30.00 per month for the first 2,000 gallons of water
$12.00 per 1,000 gallons or part thereof for all water over 2,000 gallons
** COMMERCIAL RATES:
$85.00 per month for the first 2,000 gallons of water
$12.00 per 1,000 gallons or part thereof for all water over 2,000 gallons
SEWER:
Rates are based on water consumption
** RESIDENTIAL RATES
$30.50 minimum for the first 2,000 gallons or part thereof
$ 3.00 per 1,000 gallons based on all water consumed over 2,000 gallons
** COMMERCIAL RATES
$50.00 minimum for the first 2,000 gallons or part thereof
$ 2.00 per 1,000 gallons based on all water consumed over 2,000 gallons
GARBAGE:
** Residential - $15.00 per month
** Commercial - $20.00 per month
** WATER METER TAP:
¾ inch pipe - $800.00
1 inch pipe - $1200.00
2 inch pipe - $2400.00
** WATER METER DEPOSIT: $150.00
The rate will adjust annually on December 13 with the U. S. Department of Labor, Bureau of Labor Statistics, published Consumer Price Index for All Urban Consumers (CPI-U), percentage change from January to December of the preceding year, or a 3.0% annual increase, whichever is greater.

(b) Any charges levied in subsection (a) of this section, shall be assessed the following penalty, interest and reconnection fees:

(3) Reconnect fee. If charges incurred for water, sewer and/or garbage service are in excess of $50.00 and remain unpaid by the 15th of the month the bill was issued in, or upon failure to pay two consecutive monthly bills by the 15th of the second monthly bill, water services will be disconnected after the 25th of the month. If all principal, penalty and interest are paid, services can be reestablished by the recipient paying a reconnection fee, to wit:
1st Time $ 25.00
2nd Time $ 50.00
3rd Time $ 75.00
4th Time $100.00
and by complying with current deposit requirements.

BE IT FURTHER ORDAINED that if any provision or item of this Ordinance or the application thereof is held invalid, such invalidity shall not effect other provisions, items or applications of this Ordinance which can be given affect without the invalid provisions, items or applications and to this end the provisions of this Ordinance are hereby declared severable.
BE IT FURTHER ORDAINED that all Ordinances or parts thereof in conflict herewith are hereby repealed.
