PROCEEDINGS OF THE BOARD OF ADJUSTMENT OF THE CITY OF NEW IBERIA, STATE OF LOUISIANA, TAKEN AT THE REGULAR MEETING HELD ON TUESDAY, AUGUST 23, 2022, AT 5:00 P.M. ON THE THIRD FLOOR OF CITY HALL. Wyatt Collins, Chairman, called the meeting to order, called the roll, and determined there was a quorum. ATTENDING: Wyatt Collins, Edwina Bell, Michael Johnson, Butch Thornton. ABSENT: Tommy Granger, Judy Rizzo ALSO, PRESENT: Jimmy Landry, CBO & Jane Braud, Director of Planning & Zoning Dept. MOTION TO APPROVE MINUTES: Michael Johnson offered a motion, seconded by Edwina Bell, and unanimously carried to approve the minutes of the Tuesday, July 26, 2022, meeting. Yeas: Wyatt Collins, Edwina Bell, Michael Johnson, Butch Thornton. Absent: Tommy Granger, Judy Rizzo. Nays: None

DOCKET 08.23.22BOA- #1 HOME OCCUPATIONAL LICENSE: A request by Chelsie Francois, 339 Brian St., New Iberia, LA. 70560 to obtain a home occupational license to use this address for an on-line business called “Body Unique,” to sell clothing, shoes, and accessories. Jimmy Landry reminded Board Members of a letter from the apartment building owner as previously submitted, Barbara Luke stating her objection to the home occupational license approval for her business to be located at this address. She further stated in her letter that this is an apartment rented to her mother. When asked if the building owner had withdrawn her objection, Ms. Francois stated that she hadn’t, but that she would be moving to a separate apartment and would like to apply at that address.

The consensus of the board was that she would need to reapply under the new address when she moved. Ms. Francois agreed. MOTION: Edwina Bell offered a motion, seconded by Butch Thornton and unanimously carried to withdraw Ms. Francois’ request until she had the opportunity to move to a different location and that no business transactions would take place on-site by “Body Unique” at 339 Brian St., New Iberia, La. DOCKET 08.23.22BOA-#2 HOME OCCUPATIONAL LICENSE: A request by Joseph Toucheque, 423 Bayard St., New Iberia, LA. 70560 to obtain a home occupational license to use this address for scheduling appointments, invoicing, and billing (no on-site customers) for a handy-man business called “J and A Services.” Jimmy Landry visited the location and met with Mr. Toucheque to explain that he could have no outside signage, and no customers at his home. He can use his address to conduct business inside by telephone or computer, etc. Mr. Toucheque agreed. MOTION: Michael Johnson offered a motion, seconded by Butch Thornton, and unanimously carried to approve the request for a home-occupational license at 423 Bayard St. called “J and A Services.” Yeas: Wyatt Collins, Edwina Bell, Michael Johnson, Butch Thornton. DOCKET 08.23.22BOA #3 VARIANCE: A request by Walter Jones, on behalf of the owner Frank Ivoska at 112 Bridge St. to build a 10’x18’ personal storage building in the side yard. Section 3.16 (13) of the city’s Code of Ordinances an accessary building may be built not less than sixty feet (60’) from the front lot line. Mr. James is requesting to build forty-seven (47’-10”) from the front property line, and he will need a variance of twelve feet and two inches (12’-2”). Mr. Jones presented sketches of the proposed building including his setbacks. His plans were for a storage building and there were no objectives received. MOTION: Butch Thornton offered a motion, seconded by Edwina Bell, and unanimously carried to approve the request for a variance at 112 Bridge St. to construct a storage building 10’x18’ thereby requiring a 12’-2” variance. Yeas: Wyatt Collins, Edwina Bell, Michael Johnson, Butch Thornton. Absent: Tommy Granger, Judy Rizzo. Nays: None

MOTION: There being no further business, Michael Johnson offered a motion, seconded by Edwina Bell to adjourn the August 23, 2022, of the New Iberia Board of Adjustment.
