REGULAR MEETING
JUNE 8, 2022
The Mayor and Board of Aldermen of the City of Crowley, Louisiana, the governing authority of the City of Crowley, met in a regular session at 6:00 p.m. Wednesday the 8th day of June 2022 at the regular meeting place of said Mayor and Board of Aldermen, the Council Chambers, 426 North Avenue F, Crowley, Louisiana.
Mayor Tim Monceaux presided with the following Aldermen present: Jeff Cavell, Thompson Bradford Core, Clint Cradeur, Lyle Fogleman, Jr., Samuel J. Reggie, III, Kim Stringfellow, and Byron K. Wilridge, Sr. A quorum was present.
Aldermen Vernon Martin and Steven Premeaux were absent.
Alderman Lyle Fogleman led the Pledge of Allegiance. Alderman Brad Core led the Invocation.
APPEARANCES:
Emily Stoma provided an update to the Council on the Citizens Against Blight Committee progress.
READING & APPROVAL OF MINUTES:
Alderman Jeff Cavell moved to dispense with the reading of the minutes of the May 11, 2022, Regular Council meeting seconded by Alderman Lyle Fogleman and duly adopted.
COMMITTEE REPORTS:
PUBLIC WORKS COMMITTEE:
A motion was offered by Alderman Clint Cradeur and seconded by Alderman Brad Core to approve Partial Payment Estimate No. 22 to Southern Constructors, Inc. for the City- Wide Drainage Improvements Project in the amount of $117,600.25. There being no remarks from the Council. The motion having been submitted to a voice vote; the motion carried unanimously.
A motion was offered by Alderman Clint Cradeur and seconded by Alderman Jeff Cavell to approve final Change Order No. 6 to adjust final contract time to actual contract time required; and to adjust contract quantities to final constructed quantities. There being no remarks from the Council. The motion having been submitted to a voice vote; the motion carried unanimously.
A motion was offered by Alderman Clint Cradeur and seconded by Alderman Lyle Fogleman to adopt a Resolution to terminate the contract including a Notice of Termination to be filed with the Acadia Parish Clerk of Court and begin the 45-day lien period. There being no remarks from the Council. The motion having been submitted to a voice vote; the motion carried unanimously.
A motion was offered by Alderman Clint Cradeur and seconded by Alderman Jeff Cavell To approve Partial Payment Estimate No. 7 to Glenn Lege Construction, LLC for the City-Wide Street Improvements (Contract A) Project in the amount of $82,001.13. There being no remarks from the Council. The motion having been submitted to a voice vote; the motion carried unanimously.
A motion was offered by Alderman Clint Cradeur and seconded by Alderman Lyle Fogleman to approve Partial Payment Estimate No. 1 to Glenn Lege Construction, LLC for the City-Wide Street Improvements (Contact B) Project in the amount of $1,490,870.19. There being no further remarks from the Council. The motion having been submitted to a voice vote; the motion carried unanimously.
A motion was offered by Alderman Clint Cradeur and seconded by Alderman Brad Core to adopt a Resolution authorizing the preparation of specifications and letting of bids for purchases during the period of September 1, 2022 through February 28, 2023 for the FY 2022-2023 Materials Purchases. There being no remarks from the Council. The motion having been submitted to a voice vote; the motion carried unanimously.
A motion was offered by Alderman Clint Cradeur and seconded by Alderman Lyle Fogleman to adopt a Resolution extending the contract with E.L. Habetz Buildings for work during the period of September 1, 2022 through February 28, 2023 for the FY 2021-2022 Labor & Equipment General Construction Work Contract. There being no remarks from the Council. The motion having been submitted to a voice vote; the motion carried unanimously.
A motion was offered by Alderman Clint Cradeur and seconded by Alderman Jeff Cavell to consider approval of a Cooperative Endeavor Agreement between the City of Crowley and Acadia Parish Police Jury to include patching and overlay of that portion of Northern Avenue that lies outside the city limits in the 2021 City-Wide Street Improvements (Contract B) construction contract. There being no remarks from the Council. The motion having been submitted to a voice vote; the motion carried unanimously.
UTILITY COMMITTEE:
A motion was offered by Alderman Sammie Reggie and seconded by Alderman Clint Cradeur To approve the award of construction contract for Comminutor Replacement at Main Pump Station to Tullier Servies LLC in the amount of $433,400.00 contingent upon City Attorney’s opinion regarding compliance with applicable State and Federal laws and upon concurrence in contract award with applicable state funding agencies. There being no remarks from the Council. The motion having been submitted to a voice vote; the motion carried unanimously.
RECREATION COMMITTEE:
A motion was offered by Alderman Clint Cradeur and seconded by Alderman Jeff Cavell to approve award of construction contract for the Rice Festival Building Roof Replacement Project to Roofing Solutions LLC in the amount of $318,500.00. There being no remarks from the Council. The motion having been submitted to a voice vote; the motion carried unanimously.
ZONING & ANNEXATION COMMITTEE:
A motion was offered by Alderman Lyle Fogleman and seconded by Alderman Sammie Reggie to approve the issuance of a conditional use permit to Alicia Pruitt to use the residence located at 514 West Northern as a physical therapy/Pilates wellness studio with no more than four clients at a time pursuant to favorable recommendation by the Planning and Zoning Commission. Ms. Germaine Robb spoke in opposition, and Ms. Alicia Pruitt expressed concerns. Discussion ensued between Council members Kim Stringfellow, Brad Core, Clint Cradeur, and Lyle Fogleman. The motion having been submitted to a voice vote; Alderwoman Kim Stringfellow opposed, all other Council members voted for; the motion carried.
PUBLIC SAFETY COMMITTEE:
A motion was offered by Alderman Brad Core and seconded by Alderwoman Kim Stringfellow to approve the following beer and liquor permit:

REVENUE & FINANCE COMMITTEE:
A motion was offered by Alderman Jeff Cavell and seconded by Alderman Samuel Reggie to consider accepting the audit report of the City of Crowley, Louisiana Financial Report for the year ended August 31, 2021. There being no remarks from the Council. The motion having been submitted to a voice vote; the motion carried unanimously.
ORDINANCES:
A motion was made by Alderman Lyle Fogleman and seconded by Alderman Jeff Cavell to approve an ordinance to revoke the dedication of and abandon that portion of West Elm Street east of the east line of South Avenue C between block 18 and block 34 of the South Crowley addition to the City of Crowley, Acadia parish, Louisiana, as per plat of South Crowley addition except for reservations of minerals and servitudes; to repeal all ordinances or parts of ordinances contrary thereto or in conflict therewith; to provide for the provisions hereof to be severable; and to provide for all matters relative thereto. Mayor Monceaux opened the floor for discussion. The motion having been submitted to a roll call vote.
AN ORDINANCE TO REVOKE THE DEDICATION OF AND ABANDON THAT PORTION OF WEST ELM STREET EAST OF THE EAST LINE OF SOUTH AVENUE C BETWEEN BLOCK 18 AND BLOCK 34 OF THE SOUTH CROWLEY ADDITION TO THE CITY OF CROWLEY, ACADIA PARISH, LOUISIANA, AS PER PLAT OF SOUTH CROWLEY ADDITION EXCEPT FOR RESERVATIONS OF MINERALS AND SERVITUDES; TO REPEAL ALL ORDINANCES OR PARTS OF ORDINANCES CONTRARY THERETO OR IN CONFLICT THEREWITH; TO PROVIDE FOR THE PROVISIONS HEREOF TO BE SEVERABLE; AND TO PROVIDE FOR ALL MATTERS RELATIVE THERETO.
WHEREAS, the Mayor and Board of Aldermen have received a petition prepared by the Assessor of Acadia Parish, Louisiana, James Petitjean, certifying the sole and only owner of property adjacent to the 400 block of West Elm Street is Third Crop Properties LLC which has requested the closure and abandonment of the dedication of property described as Elm Street between Blocks 18 and 34 of the South Crowley Addition of the City of Crowley requesting the closure and abandonment of the alleyway/right of way between the lots owned by Third Crop Properties LLC in Block 34 of said Addition; and
WHEREAS, the City requested a plat showing the lots and property adjacent to the Elm Street and all utilities and facilities located within the dedicated street area as well as the appropriate reservations of rights of way for utilities and drainage servitudes; and
WHEREAS, a plat of survey was prepared by Ryan P. Hebert, Registered Professional Landy Surveyor, revised April 8, 2022, which shows the portion of Elm Street to be abandoned from South Avenue C to South Avenue D, including the portion of the alleyway between the lots owned by Third Crop Properties LLC in Block 34 in the South Crowley Addition, the rezoning of Lots 6 and 7 of Block 34 and the 4’ encroachment of the west side of the right of way of South Avenue C of Block 18, which is attached hereto and made part hereof as Exhibit “A”; and
WHEREAS, underground drainage structures are shown along the northern and southern boundaries of West Elm Street between Blocks 18 and 34 and overhead power lines above the drainage culverts; and
WHEREAS, all known utility franchisees and public works, including wastewater departments, have been notified and/or contacted and have responded as to whether there is a need for reservation of a servitude; and
WHEREAS, it is necessary to reserve existing drainage and utility servitudes over and across Blocks 18 and 34 of the South Crowley Addition until completion of the reconfiguration of the new buildings and warehouse which may require relocation of the drainage servitudes; and
WHEREAS, after having examined the plat of South Crowley Addition, the Assessor’s certified list of property owners and the attached satellite/aerial photograph (identified as Exhibit “B”) of the properties in Blocks 18 and 34 of the South Crowley Addition along West Elm Street, the Board of Aldermen find that the portion of West Elm Street between Blocks 18 and 34 is contiguous and adjacent to only one property owner (Third Crop Property LLC) and there are no other property owners which would be affected by the closure; there is no disruption of traffic or congestion caused by the closure; and therefore, that portion of West Elm Street between Blocks 18 and 34 is no longer needed for any public purpose except for reservations for public utilities/drainage purposes; and
WHEREAS, the Board of Aldermen find that it is desirable to abandon the dedication of that portion of West Elm Street east of the east line of South Avenue C to its terminus between Blocks 18 and 34 of the South Crowley Addition consisting of a strip of land being sixty (60’) feet in width and that portion of the alleyway between the lots owned by Third Crop Properties LLC in Block 34 of South Crowley Addition, reserving unto the City of Crowley, its successors and assigns all of the oil, gas and other minerals in, on and appertaining thereto and reserving a public servitude and rights of way for drainage of 10’ on either side of the centerline of the existing 30” culvert and junctions as shown on the Plat of Survey Showing the Requested Abandonment of Elm Street from S. Ave. C to S. Ave. D, Showing the Requested Rezoning of Lot 6 and Lot 7 of Block 34 of South Crowley Addition, and Showing the Requested Variance for a Proposed 4’ Encroachment in the Right of Way of S. Ave. C by Third Crop Properties, L.L.C. Located in South Crowley Addition, T 10 S, R 1 E, Section 4, Acadia Parish, Louisiana, dated April 8, 2022 prepared by Ryan P. Hebert, Registered Professional Land Surveyor; and
WHEREAS, this ordinance was duly introduced and notice of this ordinance and of the public hearing having been published in accordance with law; and
WHEREAS, a public hearing having been held in accordance with law in regular session on the 9th day of February, 2022, at 6:00 o’clock p.m. at Council Chambers in the Criminal Justice Building, Crowley, Louisiana;
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF CROWLEY, PARISH OF ACADIA, STATE OF LOUISIANA, IN REGULAR SESSION DULY CONVENED THAT:
SECTION 1: That portion of West Elm Street east of the easternmost line of South Avenue C situated between Blocks 18 and 34 of the South Crowley Addition to the City of Crowley as shown on the Plat of Survey Showing the Requested Abandonment of Elm Street from S. Ave. C to S. Ave. D, Showing the Requested Rezoning of Lot 6 and Lot 7 of Block 34 of South Crowley Addition, and Showing the Requested Variance for a Proposed 4’ Encroachment in the Right of Way of S. Ave. C by Third Crop Properties, L.L.C. Located in South Crowley Addition, T 10 S, R 1 E, Section 4, Acadia Parish, Louisiana, dated April 8, 2022 prepared by Ryan P. Hebert, Registered Professional Land Surveyor, including the alleyway between the lots in Block 34, attached hereto and made part hereof, consisting of a strip of land being sixty (60’) feet in width extending east along the north right of way line of West Elm Street a distance of 270.45 feet to the westernmost boundary of South Avenue D and including that portion of the alleyway between Lots 6 and 8 and the north half (north 20’) of Lot 7 and the north half (north 20’) of Lot 9 in Block 34 as shown on the abovementioned plat which property is no longer needed for a public thoroughfare, public use or any other public purpose except for existing public drainage servitudes and reserving unto the City all of the oil, gas and other minerals in, on or appertaining thereto.
SECTION 2: The dedication and donation of that portion of West Elm Street east of the east line of South Avenue C situated between Blocks 18 and 34 of the South Crowley Addition to the City of Crowley consisting of a strip of land being sixty (60’) feet in width, in Blocks 18 and 34, including that portion of the alleyway between Lots 6 and 8 and the north half (north 20’) of Lot 7 and the north half (north 20’) of Lot 9 in Block 34, as shown on the abovementioned plat, be and the same is hereby revoked and set aside and all rights, title and interest to the City of Crowley in and to the said property thereunder be and the same is hereby revoked, abandoned and relinquished, reserving unto the City of Crowley, itself, its successors and heirs all of the oil, gas and other minerals in, on and appertaining thereto and reserving a public servitude and rights of way for drainage of 10’ on either side of the centerline of the existing 30” culvert and junctions and other public utilities pertaining to Elm Street as shown on the abovementioned plat.
SECTION 3: All the area covered by and embraced by the said property to the centerline thereof, including the alleyways, shall revert to the present owner of the said lands contiguous and adjacent thereto being Lots 1 and 7 of Block 18 and Lots 6 and 8 and the north half (north 20’) of Lot 7 and the north half (north 20’) of Lot 9 of Block 34 and the alleyway between the lots of Block 34, all is more fully shown by the abovementioned plat subject to the reservation of all oil, gas and other minerals and the reservation of servitudes/rights of way for public utilities and drainage.
SECTION 4: Said property is subject to the reservation of a public servitude and rights of way for drainage of 10’ on either side of the centerline of the existing 30” culvert and junctions as shown on the abovementioned plat. In the event the owner and its successors or assigns of the abandoned street desire to build or erect a building or structure on, over or across the public drainage servitude and/or to abandon or remove the existing 30” culvert, a substitute or alternate servitude for public drainage or improvements to the existing public drainage necessary to handle the discharge and flow of water, including the furnishing and installation of same, shall be the responsibility of the owner and its successors or assigns to provide an alternate or substitute right of way and to restore, improve and/or replace a new or additional culvert(s) of adequate size to accommodate the flow of water from north of Elm Street and east of Avenue D as may be mutually agreeable with the City and in accordance with appropriate engineering recommendations and concurrence of the City Engineer. The said property owner is required to relocate the existing sanitary sewer manhole in the alleyway to a location to be designated by the City Engineer and to bear all costs associated with the said relocation and replacement of the manhole.
SECTION 5: If any provision, part, word, section, subsection, sentence, clause or phrase of this ordinance should be held invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance and do hereby declare the provisions hereof to be severable, then in that event, only that particular provision, part, word, section, subsection, sentence, clause or phrase shall be deemed unconstitutional or invalid and the remaining provisions, parts, words, sections, subsections, sentences, clauses or phrases will not be affected and shall continue in full force and effect.
SECTION 6: All ordinances or parts of ordinances inconsistent with or in conflict herewith be and the same are hereby repealed.

A RESOLUTION OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF CROWLEY, ACADIA PARISH, LOUISIANA, DESIGNATING THE OFFICIAL JOURNAL OF THE CITY OF CROWLEY.
WHEREAS, the City of Crowley is required by LA R.S. 43:141 to designate an official journal of the City of Crowley; and
WHEREAS, the Crowley Post Signal is the only daily newspaper printed in the City of Crowley; and
WHEREAS, the City of Crowley named the Crowley Post Signal as its official journal for many years previously; and
NOW THEREFORE BE IT RESOLVED by the Mayor and Board of Aldermen of the City of Crowley, Acadia Parish, Louisiana, in regular session duly convened that the Crowley Post Signal, a daily newspaper printed in the City of Crowley, is hereby designated as the official journal of the City of Crowley for the fiscal year beginning September 1, 2022 and ending September 1, 2023 and the Mayor and Clerk are hereby authorized to notify the Secretary of State of said designation by providing him with a copy of said Resolution.
